Accommodation Terms and Conditions
(Scope of application)
Article 1
1. The accommodation contract and related agreements to be concluded between this hotel and the guest to be accommodated shall be subject to the provisions of these terms and conditions, and any matters not provided for in these terms and conditions shall be governed by laws and regulations or generally established practices.
2. In the event that the Hotel enters into a special agreement with a Guest, provided such special agreement does not violate laws, regulations or customs, the special agreement shall take precedence over the provisions of the preceding paragraph.
(Application for an Accommodation Contract)
Article 2
1. A Guest who wishes to apply for an Accommodation Contract with our Hotel shall provide our Hotel with the following particulars:
(1) Name, address, telephone number (or mobile number), email address, number of guests, and gender
(2) Date of stay and expected time of arrival
(3) Accommodation fees (in principle, based on the Basic Accommodation Fees set forth in Schedule 1)
(4) Any other matters deemed necessary by the Embassy.
2. If a Guest requests, during his/her stay, to extend his/her stay beyond the date specified in paragraph 2 of the preceding article, our hotel will treat it as if he/she had applied for a new accommodation contract at the time such request was made.
(Establishment of Accommodation Contracts, etc.)
Article 3
1. An accommodation contract shall be concluded when the hotel accepts the application as described in the previous article. However, this shall not apply when the hotel proves that it did not accept the application.
2. When an accommodation contract has been concluded in accordance with the provisions of the preceding paragraph, an application fee set by the hotel, up to the basic accommodation fee for the period of stay (if it exceeds 3 days, then 3 days), shall be paid by the date specified by the hotel.
3. The application fee shall first be applied to the accommodation fee finally payable by the Guest, and in the event of the occurrence of a situation to which the provisions of Articles 6 and 18 apply, it shall be applied in the order of penalty charges and compensation, and the remainder, if any, shall be refunded at the time of payment of the fee as provided for in Article 12.
4. If the application fee stipulated in paragraph 2 is not paid by the date specified by the hotel in accordance with the provisions of the same paragraph, the accommodation contract will become void. However, this will only apply if the hotel has so notified the guest when specifying the due date for payment of the application fee.
(Special Contracts Requiring No Deposit)
Article 4
1. Notwithstanding the provisions of Paragraph 2 of the preceding Article, our Hotel may enter into a special agreement pursuant to which the application fee stipulated in the same paragraph is not required after the contract is concluded.
2. If, when accepting an application for an Accommodation Contract, the Hotel has not requested the payment of the application fee as stipulated in Paragraph 2 of the preceding Article and has not specified a due date for the payment of the application fee, it shall be treated as if the Hotel had accepted a special contract as stipulated in the preceding Paragraph.
(Refusal to Conclude an Accommodation Contract)
Article 5
1. Our hotel may refuse to enter into an accommodation contract in the following cases:
(1) When an application for accommodation does not conform with these terms and conditions.
(2) When the Hotel is fully booked and no rooms are available.
(3) When the person seeking accommodation is deemed liable to conduct himself/herself in a manner that will violate the provisions of the law, the public order or good morals in regard to his/her accommodation.
(4) When the person seeking accommodation is deemed to be under any of the following items (a) to (c):
(a) When the person is a member of an organized crime group as defined in Article 2, Paragraph 2 of the Law Concerning Prevention of Unjust Acts by Organized Crime Group Members (Law No. 77 of 1991) (hereinafter referred to as an "organized crime group"), a member of an organized crime group as defined in Article 2, Paragraph 6 of the same Law (hereinafter referred to as an "organized crime group member"), a semi-regular member of an organized crime group, or a person related to an organized crime group, or other anti-social forces.
(b) When a corporation or other organization whose business activities are controlled by an organized crime group or a member of an organized crime group.
(c) When a corporation has an officer who is considered a member of an organized crime group.
(5) When a person seeking accommodation behaves in a manner that causes significant nuisance to other guests.
(6) When the person seeking accommodation can be clearly detected as carrying an infectious disease.
(7) When the Guest is subjected to violent demands or is asked to assume an unreasonable burden in relation to his/her accommodation.
(8) When the Hotel is unable to provide accommodation due to natural disasters, malfunction of facilities, or other unavoidable causes.
(9) When the guest falls under any of the following cases as provided for in Article 5 of the Oita Prefecture Hotel and Inn Business Act Enforcement Ordinance:
When the Guest is intoxicated or for other reasons is likely to cause inconvenience to other Guests.
(b) When the Guest causes trouble to other guests during their stay.
(c) When the guest fails to provide necessary information to be entered in the guest register even when requested.
(10) When a guest has made violent, intimidating, blackmailing or coercive demands on the accommodation facility or the accommodation facility staff (employees), or has demanded an unreasonable burden from the accommodation facility, or when it is deemed that the guest has engaged in similar behavior in the past.
(Guest's Right to Cancel Accommodation Contract)
Article 6
1. The Guest may cancel the Accommodation Contract by notifying the Hotel.
2. In the event that a guest cancels the accommodation contract in whole or in part due to reasons attributable to the guest (except in the event that the hotel has requested payment of the application fee by specifying a due date in accordance with the provisions of Article 3, Paragraph 2 and the guest cancels the accommodation contract prior to such payment), the hotel shall charge a penalty as listed in Attached Table 2. However, in the event that the hotel has accepted a special agreement in accordance with Article 4, Paragraph 1, this shall apply only when the hotel has notified the guest of the obligation to pay the penalty when the guest cancels the accommodation contract.
3. If a guest does not arrive by 8 p.m. on the day of the stay without contacting the hotel (or by two hours after the expected arrival time if the guest has stated the expected arrival time in advance), the hotel may regard the accommodation contract as having been cancelled by the guest and proceed with the matter accordingly.
(The Hotel's Right to Cancel the Contract)
Article 7
1. Our hotel may cancel the accommodation contract in any of the following cases.
(1) When the Guest is deemed liable to conduct himself/herself in a manner that will violate the laws and regulations, public order or good morals in regard to his/her accommodation, or when he/she is deemed to have conducted such conduct.
(2) When the Guest is deemed to be under the following category (a) to (c):
(a) When the person is a member of an organized crime group, a gang member, a semi-regular member of an organized crime group, or a person related to an organized crime group or other anti-social forces.
(b) When a corporation or other organization whose business activities are controlled by an organized crime group or a member of an organized crime group.
(c) When a corporation has an officer who is considered a member of an organized crime group.
(3) When the Guest behaves in a manner that causes significant nuisance to other Guests.
(4) When the Guest can be clearly detected as carrying an infectious disease.
(5) When the Guest is subjected to violent demands or is asked to assume an unreasonable burden in relation to his/her accommodation.
(6) When the Hotel is unable to provide accommodation due to a natural disaster or other force majeure.
(7) When the case falls under Article 5 of the Oita Prefecture Hotel and Inn Business Act Enforcement Ordinance.
When the Guest is intoxicated or for other reasons is likely to cause inconvenience to other Guests.
(b) When the Guest causes trouble to other guests during their stay.
(c) When the guest fails to provide necessary information to be entered in the guest register even when requested.
(8) When the Guest smokes in bed, tampers with fire-fighting equipment, or fails to comply with other prohibited activities stipulated by the Hotel (limited to those necessary for fire prevention purposes).
(9) When a Guest has made violent, intimidating, blackmailing or coercive demands on the accommodation facility or the accommodation facility staff (employees), or has demanded an unreasonable burden from the accommodation facility, or when it is deemed that such conduct has been committed in the past.
2. When our hotel cancels the accommodation contract in accordance with the provisions of the preceding paragraph, we will not charge the guest for any accommodation services etc. that he/she has not yet received.
(Accommodation registration)
Article 8
1. The Guest will be required to register the following particulars at the front desk of the hotel on the day of accommodation:
(1) Name, age, sex, telephone number (or mobile number), email address, address and occupation of the guest
(2) For foreign nationals (those not residing in Japan), nationality, passport number (we will take a copy of your passport), place of entry and date of entry
(3) Departure date and scheduled departure time
(4) Any other matters deemed necessary by the Embassy.
(Guest room occupancy hours)
Article 9
1. Guests may use the guest rooms of our hotel from 3:00 p.m. to 11:00 a.m. the following morning. However, in the case of consecutive stays, guests may use the guest rooms all day, except on the days of arrival and departure.
2. Our hotel does not offer early check-in or late check-out.
(Observance of the rules of use)
Article 10
1. Guests must abide by the rules and regulations established by the hotel and posted within the hotel.
(Business hours)
Article 11
1. The opening hours of our facilities are as follows. Detailed opening hours of other facilities will be posted in various locations, in the service directories in the guest rooms, etc.
Front desk/cashier service hours: 7:00am to 8:00pm
2. The hours set out in the preceding paragraph may be subject to temporary change due to unavoidable circumstances. In such cases, we will notify you by appropriate means.
(Payment of fees)
Article 12
1. The breakdown of the accommodation fees, etc. to be paid by the Guest shall be as set forth in Attached Table 1.
2. In the case of advance payment, the accommodation fee etc. mentioned in the previous paragraph shall be paid by credit card through the reservation site at the time of reservation. The bathing tax (250 yen/person) will be collected at the front desk or in the guest room upon check-out. In the case of on-site payment, payment shall be made by cash or a credit card approved by the hotel at the front desk or in the guest room upon check-out.
3. Accommodation fees will be charged even if the Guest voluntarily does not utilize the guest room after the Hotel has provided it to the Guest and made it available for use.
(Responsibilities of the Museum)
Article 13
1. When the hotel has caused damage to a guest in the fulfillment or non-fulfillment of the accommodation contract and related agreements, the hotel shall compensate for such damage. However, this shall not apply when such damage is due to reasons not attributable to the hotel.
2. Our hotel is covered by hotel liability insurance to cover the unlikely event of a fire or other incident.
(Handling when contracted rooms cannot be provided)
Article 14
1. When our hotel is unable to provide a contracted room to a Guest, we will, with the Guest's consent, arrange accommodation of the same standards elsewhere for the Guest, wherever possible.
2. Notwithstanding the provisions of the preceding paragraph, if the hotel is unable to arrange other accommodations for the guest, the hotel shall pay the guest a compensation fee equivalent to the breach of contract charge, which shall be applied to the amount of damages. However, if the hotel is unable to provide a room due to reasons beyond the hotel's control, the hotel shall not pay the compensation fee.
(Handling of Deposited Items, etc.)
Article 15
1. When loss, breakage or other damage occurs to goods, cash or valuables deposited at the front desk by a guest, the hotel shall compensate for such damage, except in cases where such loss or damage is due to force majeure. However, in the case of cash and valuables, if the hotel requests a declaration of their type and value and the guest fails to do so, the hotel shall compensate for such damage up to a maximum of 150,000 yen.
2. When loss, breakage or other damage occurs due to the intention or negligence of the hotel to any goods, cash or valuables brought into the hotel by a guest but not deposited at the front desk, the hotel shall compensate for such damage. However, for any items for which the guest has not reported the type and value in advance, the hotel shall compensate for such damage up to a maximum of 150,000 yen, except in cases where the loss is due to the intention or gross negligence of the hotel.
(Care of Guest's Baggage and Belongings)
Article 16
1. When the baggage of the Guest is brought into the Hotel prior to his/her stay, the Hotel shall be responsible for storing it only when such request has been approved by the Hotel in advance and shall hand it over to the Guest at the front desk at the time of his/her check-in.
2. If a guest's baggage or belongings are found left behind at the hotel after checking out, and the owner is identified, the hotel will contact the owner and ask for instructions. However, if there is no instruction from the owner or the owner is not identified, the hotel will store the baggage or belongings for seven days, including the day they were found, and then deliver them to the nearest police station.
3. The liability of our hotel regarding the custody of the Guest's baggage and belongings in the cases of the two preceding paragraphs shall be in accordance with the provisions of the preceding Article, Paragraph 1 in the case of Paragraph 1, and with the provisions of the same Article, Paragraph 2 in the case of the preceding paragraph.
(Liability for Parking)
Article 17
1. Our hotel's private parking lot can be used free of charge for one car per reservation.
2. When guests use the hotel's private parking lot, regardless of whether the guest has deposited the vehicle key with the hotel, the hotel only lends the parking space and is not responsible for managing the vehicle or for preventing damage caused by third parties. However, if the hotel causes damage through its intention or negligence in managing the parking lot, the hotel will compensate for the damage.
(Guest Liability)
Article 18
1. When the Guest causes damage to the Hotel through intent or negligence on the part of the Guest, the Guest will compensate the Hotel for such damage.
2. If tax laws are revised, the revised provisions shall apply.
